    In CLARITY Act news, odds that the bill becomes law in 2026 collapsed to as low as 16% on Polymarket on Monday, before rising to 21% today but still down -44% over the past 24 hours. This follows key Senate Democrats saying Republicans’ latest “final” ethics offer had not swayed them.

    The bill needs 60 votes to clear a US Senate procedural motion on Tuesday, and that threshold looks shakier now than it did a day earlier, when the same market briefly spiked to 35% on hope a deal was within reach.

    That swing captures how fragile the coalition behind the CLARITY Act has become. Here is the tension driving the market: Republicans insist they have given Democrats everything they can on ethics.

    Meanwhile, Democratic negotiators say the corruption safeguards still fall short, and that gap could sink the year’s most consequential piece of crypto regulation before it ever reaches a floor vote.

    Why Does the 60-Vote Wall Matter for the CLARITY Act?

    The CLARITY Act would draw a jurisdictional line between the SEC and the CFTC, splitting oversight of the US digital-asset market between the two regulators rather than leaving it to case-by-case enforcement.

    That framework is exactly what’s stalled in the US Senate, where clearing the 60-vote Senate cloture hurdle has proven far harder than passing the House version last year.

    On Polymarket, the mechanics are simple: traders buy contracts that pay $1 if an event resolves “Yes” and nothing if it resolves “No,” so the contract’s price is effectively real money betting on an outcome, not a poll.

    When the CLARITY Act’s “Yes” price fell from 35% to 16% in roughly a day, it reflected traders repricing the odds of a floor vote succeeding, not new legislative text itself.

    CLARITY Act News: Where the Ethics Fight Actually Stands

    Senate Democrats’ resistance centers on one word: enough. Senator Mark Warner, one of the lawmakers involved in negotiations, said the revised ethics provision was not “near enough,” according to a post from Punchbowl News’ Burgess Everett.

    Senator Raphael Warnock went further, arguing Democrats should not advance legislation that fails to address opportunities for corruption occurring “in real time,” Punchbowl News’ Brendan Pedersen reported.

    Senator Ruben Gallego called the latest ethics language “much to be desired” and said he would draft his own counterproposal, Pedersen reported separately.

    Staff for Senator Elizabeth Warren on the Senate Banking Committee circulated talking points warning that a proposed state attorney general enforcement mechanism could be overridden by White House ethics officials.

    Not every Democrat is dug in. Senator Kirsten Gillibrand privately urged colleagues to support the procedural motion, Politico reported.

    On the Republican side, Senator Cynthia Lummis said President Donald Trump had accepted two significant ethics provisions and that there was “nothing left to give,” rejecting the idea Republicans could bend further. Democrats have since sent a counterproposal to GOP negotiators, according to Politico’s Jasper Goodman.

    The Fight Extends Beyond Ethics as Banks Weigh In

    In other CLARITY Act news, Ethics is just one challenge for the bill. Eight banking trade groups, including the American Bankers Association, raised concerns on September 14 about the revised text allowing stablecoins to pay rewards similar to deposit interest. They criticized the proposed “circuit breaker” for only activating after serious issues arise.

    The Indian Gaming Association urged tribes to oppose the bill because it offers inadequate protections for tribal sovereignty, asking for clear language that federal commodities law does not override state gaming laws. This concern, along with objections from 18 state attorneys general, complicates efforts to secure the 60 votes needed.

    Despite this opposition, Blockchain Association CEO Summer Mersinger said the crypto industry has made concessions to build bipartisan support.

    Negotiators agree that prior ethics language was inadequate, but Republicans refuse to make further concessions. The key question is whether the Democrats’ counterproposal will lead to last-minute changes or if the likelihood of a “no” vote will continue to rise, currently above 80%.
