The student, who received their denial on September 16, 2025, shared a detailed timeline—application, premium processing, an RFE, an RFE response, and finally a denial just weeks before starting a new job.While the case details vary for each applicant, immigration attorneys say STEM OPT denials in 2025 are often linked to issues around employment compliance, training plans, or perceived gaps in work authorization. Here is a breakdown of what a denial means, why it can happen, and the options students still have.

    Immigration experts note that in the last two years, USCIS has tightened scrutiny of whether a student’s work truly meets STEM OPT criteria.     Does a STEM OPT denial end your legal status immediately?

    F-1 grace period

    —as long as:

    • The initial 12-month OPT was still valid when the STEM OPT application was filed.
    • The student did not continue working after OPT expired unless authorized under the STEM OPT automatic extension (known as the 180-day extension).

    If a student keeps working only during the automatic extension, status remains intact until the denial date. After denial, the 60-day countdown begins.

    What students can do after a STEM OPT denial

    Once the official denial notice arrives, several pathways may still be open. Attorneys recommend acting quickly, because timelines can be tight.

    1. File a Motion to Reopen or Reconsider (MTR)

    If USCIS made a factual or legal error—or if new documents can clarify employment eligibility—students can file an MTR. This option is strongest when the denial was due to misunderstanding or incorrect interpretation of the training plan, employer details, or payroll evidence.However, an MTR does

    not

    restore work authorization while pending. Students must stop working unless they also have another valid status or authorization.

    2. Refile a new STEM OPT application

    If the denial is due to a correctible issue and the student is still within the 60-day grace period—and their DSO can reissue an updated I-20—an entirely new STEM OPT application may sometimes be possible. This is dependent on whether your original OPT period ended less than 60 days before the new filing.This option works only if USCIS rules the original filing as “timely” and the DSO is willing to recommend a fresh extension.

    3. Transfer to a new academic program

    Enrolling in a new degree (even online or part-time in some cases) can help maintain F-1 status. Many students use this to bridge a gap while preparing for another attempt at work authorization later.However, transferring means giving up the remaining OPT period and starting fresh with a new academic record.

    4. Switch employers and explore a cap-exempt H-1B or O-1 path

    If the student has a firm job offer—as in the Reddit case, where a new position was supposed to start on September 29—cap-exempt H-1B (through non-profits or universities) may be an option. Highly skilled profiles in research or innovation may also qualify for O-1 pathways.These options depend heavily on employer sponsorship capacity.

    Some graduates switch to visitor status (B-1/B-2) to wrap up personal matters before leaving, while others explore work visas from outside the US, such as H-1B, L-1, or J-1. Departure is sometimes the cleanest option to protect future immigration prospects, especially if status violations are a risk.

    What students can do while waiting for the denial notice

    Most attorneys recommend that students:

    1. Stop working immediately until they understand their status.
    2. Contact their DSO to clarify grace period timelines.
    3. Prepare documents proving the validity of their employment, payroll, and training plan.
    4. Consult an immigration attorney quickly, because MTR and refiling deadlines are short.
