ICE’s Hyperliquid perps deal tests the CFTC’s perp pathway

Intercontinental Exchange, the owner of the New York Stock Exchange, has agreed with Trade[XYZ] to build a regulated U.S. market for Hyperliquid-based perpetual futures, pending Commodity Futures Trading Commission approval.

Announced on 29 October, the deal puts ICE in charge of the exchange and clearing infrastructure, Trade[XYZ] in charge of designing the markets, and Hyperliquid supplying the technology through its HIP-3 framework. Contracts would span crypto, equities, indices, commodities and foreign exchange, offered through participating brokers. ICE is also taking a minority stake in Trade[XYZ], without disclosing its size or a launch date.

The telling part of the announcement is the regulatory frame around it: nothing can trade until the CFTC signs off, and the venue would not exist without the pathway the regulator opened in May.

    The runway the CFTC built

In May 2026 the CFTC issued a staff advisory and no-action relief clearing the way for perpetual futures in the United States, and cleared Kalshi’s bitcoin perpetual contract as the first precedent. The ICE and Trade[XYZ] plan is the most prominent product built on that framework so far, and the fact that an operator of the NYSE’s size chose to build through it is the clearest signal yet that the advisory route is becoming a working lane for perps.

Political appetite sits behind it too. In August, President Trump said Chair Michael Selig was working to bring Hyperliquid into the U.S. in a “fully compliant and legal fashion”.

Intercontinental Exchange (ICE) and trade[XYZ] have announced their plan to use Hyperliquid as the infrastructure layer to deploy perpetual futures markets for US traders across crypto, equities, commodities, foreign exchange, and other real-world assets, subject to regulatory… https://t.co/rgwG9KjgYI

What still has to be approved

The compliance shape is already set out. The announcement describes U.S. markets designed to meet know-your-customer and anti-money-laundering rules, with verified customers connecting through futures commission merchants. ICE will also seek approvals to support trading with leverage, and those permissions are the part still to come.

Distribution may run through ICE’s joint venture with OKX, whose own U.S. regulatory approvals remain pending, so a second set of permissions hangs off the same runway. That venture has already drawn objections from 38 companies. How durable the pathway proves to be is also worth watching: analysts at TD Cowen have warned the CFTC’s crypto rules may not survive past the 2028 election, which would put any launch approval inside a window that could later be reworked. The broader supervisory architecture is also still in motion: our earlier coverage of the CFTC’s proposed Regulation CTX and CAM frameworks explains how exchange oversight is being rebuilt alongside these product approvals.

Today, Hyperliquid’s perps platform operates outside the United States and is not officially accessible to U.S. participants. The new venue does not change that yet; nothing is live onshore.

ICE’s own words on why it is building the retail side now, from ICE chair and chief executive Jeffrey Sprecher: “We’ve seen a clear increase in retail participation in markets, and that participation is becoming far more global, with retail traders increasingly seeking short-duration exposure, often around the clock.” He added that ICE sees the perp markets as additive to its futures markets, not a replacement for them.

    Why it matters for positioning

Five months earlier the picture was different: in May, ICE and CME Group were reported to be pressing regulators to scrutinise Hyperliquid over manipulation and sanctions-evasion risk. The October agreement is a full reversal, and it tells readers that the offshore perp market is being brought onshore through regulated channels rather than shut out. HYPE, Hyperliquid’s token, jumped sharply on the announcement, trading at $91.21 on 29 October, against an all-time high of $97.96 set in September.

The next dated step is the CFTC’s decision itself: until it grants the approvals, including for trading with leverage, the U.S. venue stays a plan on paper.
